Probably a very old Mafia movie

I can recall distinctly this scene but not a single actor unfortunately

Basically they are in this building, likely a small conference room and there is probably a shooting with guns

One of the police guy rushes in but is caught off guard by a Mafia guy with a gun, so he can’t move right?

The mafia guy asks the police guy: do you have family?

The police guy says: yes I do

Then the mafia guy does a head movement like to say: yeah… you deserve to live

So he lowers his gun slightly and the police guy picks his gun and shoots the mafia guy

I searched and watched many mafia movie but I really can’t find this one for the heck of me

“Edge of Darkness” (2010)

Actor Ray Winstone plays the guy who asks the policeman if he has a family and then lowers his gun and gets shot by the policeman.
Quote from the movie’s Wikipedia page:
“When a young police officer nervously enters the Senator’s room, Jedburgh asks the officer at gunpoint if he has children. When the officer replies yes, Jedburgh lowers his gun, allowing the officer to shoot him dead.”
